High Stakes in High School: How AI Discipline Can Derail Elite Academic Futures

Families devote years to helping students craft resumes that make them highly sought after by the best colleges and universities. A perfect GPA. Stellar test scores. Outstanding extracurricular achievements. But years of hard work can be undone by AI detection software.

High schools are terrified of losing control of students. Cell phones were once the biggest problem. But the explosion of AI has now become the primary concern. To protect their reputations, schools are adopting zero-tolerance policies and punishing students for “AI cheating” often on the basis of very little evidence.

Before meekly accepting discipline, students and their families need to understand what is at stake and how damaging it can be to future prospects. In many cases, the findings and disciplinary actions can be challenged and removed from students’ records, protecting their futures.

Why Accusations of AI Misuse are So Damaging to High School Students

Even something seemingly minor, such as a single episode of after-school detention, can be very damaging to a high-school student’s record. Any mention of rule violations or even a hint of academic dishonesty can make a student appear to be a potential liability rather than an asset to a college. School officials reviewing these records will not see the details of a situation. They will not know if the student was being penalized for violating a policy imposed retroactively. They will not know if “proof” of the violation came from faulty software. All they will see is a negative notation and a reason to deny admission.

Discipline over AI use can lead to problems such as:

  • Removal from National Honor Society
  • Loss of leadership positions
  • Lower grades
  • Damage to reputation that can lead to a snowball effect

Once found “guilty” of academic dishonesty, a student can become a target in other classes. Other teachers may suddenly begin finding problems with the student’s work that they never noticed before. If a student has already been accepted to college or an elite internship or summer program, their admission may be rescinded. Scholarships can be withdrawn. And the reason for these actions can haunt the student indefinitely. 

Accusations of AI misuse are so damaging because they raise two critical issues. They make the students’ academic abilities seem weak, and their integrity even weaker. The double blow can damage reputation in a way that is impossible to remedy.

AI Detection Tools are Often Flawed

Many times, schools discipline students for using AI without having definitive proof that the use violated school rules or that AI was even used. Unlike traditional plagiarism checkers, which produce evidence that is hard to contradict, AI checkers analyze information in ways that often yield incorrect results. Studies have shown that AI detection software frequently produces false positive results, particularly for students who:

  • Use neurodivergent thought processes
  • Learned English as a second language
  • Are trying to adopt styled language patterns standard in certain fields, such as medicine and law

AI detection software can be a useful tool for indicating when it may be necessary to initiate an investigation into potential AI misuse. However, this tool should be viewed as the starting point of an investigation, not the sole evidence of wrongdoing. Far too often, schools rely on the results of one or two software evaluations to conclude that a student is responsible for misconduct.

Findings based on this type of flawed evidence can and should be challenged. Students have a right to due process before being subjected to discipline, and investigations into potential misuse of AI often violate those rights. However, when students don’t take appropriate action to protect their rights, they end up forfeiting them.

Retroactive Application of AI Policies

Situations involving allegations of AI misuse become extremely complicated because of the rapid evolution of software, evolving human uses, and school policies that are trying to keep pace. School officials may insist that a student has violated a rule that did not exist at the time of the alleged violation.

When AI policies are unclear or out of date, schools will accuse students of violating general rules about “academic integrity.” Depending on the circumstances, this can be challenged as an arbitrary and capricious application of the rules that violates the student’s rights.

A recent case in Massachusetts addressed this issue and concluded that students’ rights were not violated by the school’s application of disciplinary policies regarding AI use. However, in that case, the school used numerous techniques to verify the use of AI. The court did not find that the student was responsible for violating a retroactively imposed policy, but did find that the student was responsible for violating rules on plagiarism and cheating. Although the court upheld the school’s position in this particular instance, the detailed analysis in this case indicates that courts are willing to seriously assess whether schools are taking appropriate steps before imposing discipline for AI use.
